One In The Hand, Inc. (d/b/a "OITH," "we," "us," or "our") operates the OITH mobile application and related services (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service.

By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with our policies and practices, please do not use the Service.

We are committed to protecting your privacy and ensuring the security of your personal information. This Privacy Policy describes our practices regarding data collection, use, and sharing. Please read this policy carefully to understand our views and practices regarding your personal data.

2. Information We Collect

2.1 Information You Provide Directly

We collect information that you provide directly to us when you:

  • Create an Account: When you register for an account, we collect your email address, phone number (if provided), name, date of birth, and password.
  • Complete Your Profile: We collect information you provide in your profile, including photos, biographical information, preferences, interests, and other details you choose to share.
  • Communicate with Other Users: We collect messages, photos, and other content you send through the Service's messaging features.
  • Use Date Planning Features: We collect information about date preferences, location preferences, and date planning details.
  • Make Payments: When you subscribe to our Service, payment processors collect payment information (credit card details, billing address). We do not store full payment card information on our servers.
  • Contact Us: When you contact customer support or communicate with us, we collect the information you provide, including your name, email address, and the content of your message.

2.2 Information We Collect Automatically

When you use the Service, we automatically collect certain information, including:

  • Device Information: We collect information about your device, including device type, operating system, unique device identifiers, mobile network information, and device settings.
  • Location Data: With your permission, we collect precise or approximate location data from your device to facilitate proximity-based matching. Location data is collected only when the app is actively in use and is not stored beyond the active session unless you enable location history.
  • Usage Information: We collect information about how you use the Service, including features you access, time spent on the Service, pages viewed, actions taken, and interactions with other users.
  • Log Data: We automatically collect log information when you use the Service, including IP address, access times, app features or pages viewed, app crashes and other system activity, and the type of browser or device you use.
  • Cookies and Similar Technologies: We use cookies, web beacons, and similar tracking technologies to collect information about your interactions with the Service. You can control cookies through your browser settings.

2.3 Information from Third Parties

We may receive information about you from third parties, including:

  • Social Media Platforms: If you choose to connect your account to a social media platform, we may receive information from that platform in accordance with your privacy settings.
  • Payment Processors: When you make a purchase, our payment processors provide us with transaction information.

  • Ensure Safety and Security: Detect, prevent, and address fraud, abuse, security issues, and other harmful activity. We may use automated tools to review content for safety purposes.
  • Comply with Legal Obligations: Comply with applicable laws, regulations, legal processes, and governmental requests.
  • Analytics and Research: Analyze usage patterns, conduct research, and improve our Service. This includes using aggregated and anonymized data for analytics purposes.
  • Marketing: With your consent, send you marketing communications about our Service, features, and promotions. You can opt out of marketing communications at any time.

4. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

4.1 With Other Users

As part of the Service, we share your profile information, photos, and other information you choose to include in your profile with other users who are matched with you. Messages you send to other users are visible to those users.

4.2 With Service Providers

We share information with third-party service providers who perform services on our behalf, including:

  • Cloud Hosting Providers: We use cloud hosting services (such as AWS) to store and process your data. All data is encrypted in transit and at rest.
  • Payment Processors: We work with payment processors to handle subscription payments. Payment processors have their own privacy policies governing the use of your payment information.
  • Analytics Providers: We use analytics services to understand how users interact with the Service. These services use anonymized and aggregated data.
  • Content Moderation Services: We may use third-party services to help detect and prevent harmful content, spam, and abuse.
  • Communication Services: We use services to send emails, push notifications, and other communications.

All service providers are contractually obligated to protect your information and use it only for the purposes we specify.

4.3 For Legal Reasons

4.4 Business Transfers

5. Data Retention

We retain your information for as long as necessary to provide the Service and fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

  • Active Account Data: We retain information associated with your account for the duration of your account's existence.
  • Deleted Messages: Messages you delete are permanently removed from our systems within 30 days of deletion.
  • Inactive Accounts: If your account is inactive for 2 years, we may delete your account and associated data, subject to legal retention requirements.
  • Backup Data: Backup copies of data are retained for 90 days before being permanently deleted.
  • Analytics Data: Aggregated and anonymized analytics data may be retained for up to 2 years for research and improvement purposes.

When you delete your account, we will delete or anonymize your personal information, except where we are required to retain it for legal, regulatory, or safety reasons.

6. Your Rights and Choices

You have the following rights regarding your personal information:

6.1 Access and Portability

You have the right to access the personal information we hold about you and to receive a copy of your data in a portable format. You can access much of your information directly through the Service, or you can request a copy by contacting us at privacy@oith.com.

6.2 Correction

You can update most of your information directly through the Service. If you need assistance updating information, please contact us at support@oith.com.

6.3 Deletion

You can delete your account at any time through the Service settings. When you delete your account, we will delete your personal information, subject to legal retention requirements. To request deletion, contact us at privacy@oith.com.

6.4 Opt-Out of Marketing

You can opt out of marketing communications by clicking the unsubscribe link in any marketing email or by adjusting your notification preferences in the Service settings.

6.5 Location Data

You can control location data collection through your device settings. You can disable location services for the OITH app at any time, though this may limit certain features of the Service.

6.6 California Privacy Rights

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including:

  • The right to know what personal information we collect, use, and disclose
  • The right to delete your personal information
  • The right to opt-out of the sale of personal information (we do not sell personal information)
  • The right to non-discrimination for exercising your privacy rights

If you are located in the European Economic Area (EEA) or United Kingdom, you have additional rights under the General Data Protection Regulation (GDPR), including:

  • The right to object to processing

7. Data Security

We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include:

  • Regular security assessments and updates
  • Access controls and authentication requirements
  • Secure data centers and infrastructure

However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security.

8. Children's Privacy

The Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 18. If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately at privacy@oith.com. If we become aware that we have collected personal information from a child under 18, we will delete that information promptly.

9. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence. These countries may have data protection laws that differ from those in your country.
